Careless driving is one of the most serious traffic tickets under the Highway Traffic Act of Ontario. Careless driving is defined as driving "without due care and attention, or without reasonable consideration for other persons using the roadway".

To be convicted in court for careless driving, the police and prosecutor have to prove all the essential elements of the charge described in section 130 of the Ontario Highway Traffic Act, "beyond a reasonable doubt". Basically this covers who, what, where, when and how the offence occurred. If the prosecution can not prove all the issues covered in the Highway Traffic Act for careless driving, the Justice of the Peace could/may dismiss the charge.
