Careless Driving - Fighting a careless driving ticket
Careless driving is one of the most serious traffic tickets under the Highway Traffic Act of Ontario. Careless driving is defined as driving "without due care and attention, or without reasonable consideration for other persons using the roadway".
A careless driving ticket has the following penalties:
- Fine of $490 to $1,000
- 6 demerit points
- Possible suspension of your driving licence (serious offences only)
- Possible jail term of up to 6 months (serious offences only)
For careless driving there are also serious insurance implications including cancellation of your insurance policy, or your insurance rates canl be raised thousands of dollars per year.
A conviction for careless driving stays on your driving record for 3 years, insurance companies may keep a careless driving conviction on their records for even longer.
To be convicted in court for careless driving, the police and prosecutor have to prove all the essential elements of the charge described in section 130 of the Ontario Highway Traffic Act, "beyond a reasonable doubt". Basically this covers who, what, where, when and how the offence occurred. If the prosecution can not prove all the issues covered in the Highway Traffic Act for careless driving, the Justice of the Peace could/may dismiss the charge.

A provincial prosecutor represents the police officer at traffic court. The prosecutor is trained to prosecute and convict the motorist. So you need someone on "your side" that is equally trained and knowledgeable to represent your interests in court, or you could risk being convicted.
