If you have receive a speeding ticket you have two options. Pay the ticket and accept the penalties or fight the ticket.
Should you just pay the ticket? Maybe you have a defense to speeding? Will the speeding ticket affect your insurance rates? Are there demerit points for the speeding ticket?
Even a minor speeding ticket has more penalties than just the fine. Each speeding ticket has numerous penalties that neither the police nor the prosecution are obligated to tell you about that can affect your insurance rates, and your right to drive.
As with all traffic and speeding tickets the first thing to do is to find out all the facts, and learn what are the implications of the ticket. When you call OTT Legal Services our trained legal representatives and former police officers can tell you all about the speeding ticket.
Having learned the facts you now can properly decide what to do about the speeding ticket. Most speeding ticket will give you three or four options of what to do.
1. Pay the Speeding Ticket - Never adviseable. If you pay the speeding ticket all of the penalties for a speeding violation will go immediate on your driving record/abstract and any demerit points. A conviction for speeding or any traffic ticket is kept on your driving record for three years from the date the ticket was paid.
2. Plead Guilty with an Explaination - Never adviseable. If you plead guilty with an explaination you have to go to the court and see the Justice of the Peace. The Justice of the Peace will listen to your explaination regarding your speeding ticket. After listening to your explaination ALL the Justice of the Peace is allow to do is lower the fine.
The Justice can not withdraw, dismiss or cancel the demerit points from the ticket. If you plead guilty with an explaination a conviction and any demerit points will go on your driving record, and is available to your insurance company.
3. Meet the Prosecutor to discuss your case - Never adviseable. When you appear at the court house many of the clerks will offer to allow you to meet with the prosecutor to "Avoid a Contested Trial", offering to let you try to come to a resolution with the prosecutor without going to traffic court for a trial.
It is highly improper and against the law for a clerk at court to give or offer legal advice. There maybe many issues that can cancel your ticket and a clerk is not qualified to advise you. If you do meet with the prosecutor you lose any opportunity to win your case from very simple reasons to complicated legal arguements made by a licenced professional. For example for every court case the officer has to appear in court. If the officer does not appear there is a very good chance your ticket will be dismissed, usually any resolution available at a meeting with the prosecutor or "first attendance meeting" is available on a trial date.
Meetings with the prosecutor, and "first attendance" was originally set up for the person who forgot their drivers licence or insurance and was stopped by the police. In order to save court time, the court administation set up these meetings to cancel these tickets. After seeing what a success they were the administration started expanding the meetings to include many other tickets. Thereby saving costs to the system, e.g. not having to pay for police officers to attend court, and ensuring that the defendant was convicted of something, and allowing the municipality to collect the fines.
4. Fight the Speeding Ticket - Always adviseable. Fighting the speeding ticket or any traffic ticket is the best way to ensure that you have the best chance to kept your driving record clear of the offence. When you fight the speeding ticket the prosecution is has the obligation to prove the case against your before you have to defend yourself. If the police or prosecution cannot prove the case for any reason the speeding ticket can be dismissed keeping your driving record clear and your insurance rates low.
If you fight the speeding ticket yourself you always have a chance to win the case.
