Ignition Interlock System - Getting your Drivers licence Back

Convicted drivers of a drinking and driving offence must apply to the Ministry of Transportation to have their drivers licence reinstated. As part of that process driver are required installed into their motor vehicle and or any motor vehicle at they wish to drive a ignition interlock device.

The interlock system is a in-car breathalyzer device that stops the vehicle from being operated until the driver provides a suitable sample of their breath into the machine. If the machine detects alcohol in the drivers breath the motor vehicle will not start.

As well while driving the motor vehicle the driver is required to provide further samples. Again if the interlock system detects alcohol the vehicle horn and lights will be activated and flash until the driver brings the vehicle to a stop.

The cost of the interlock system is approximately one thousand five hundred dollars ($1500), as well the driver must have the vehicle and interlock system tested month to ensure that it is working properly and has not been tampered with.

After serving the current provincial sanctions, including licence suspensions and a mandatory remedial program, those eligible to have their driver's licence reinstated will have an ignition interlock condition placed on their driver's licence for at least one year. Drivers who choose not to install a device must not drive until the condition is removed from their licence.

Drivers who are found driving a vehicle without the ignition interlock device installed may be arrested and charged with the criminal offence of Drive While Disqualified, or be charged under the Highway Traffic Act of Ontario.

First-time offenders will have an ignition interlock condition on their licence(s) for a minimum of one year.

Second-time offenders will have the ignition interlock condition for a minimum of three years.

Third-time offenders will have a lifetime ignition interlock condition placed on their licence(s), if it is reinstated after a minimum 10-year suspension. The program does not apply to fourth-time offenders, as their licence(s) will never be reinstated.

When the ignition interlock condition period is over, the driver must apply to the Ministry of Transportation to have the condition removed from his or her licence.

The device is installed for the ignition interlock condition period. It must be used by anyone who drives the vehicle, including family and friends. Offenders can choose not to drive until the ignition interlock condition is removed from their licence.

Drivers subject to an ignition interlock condition are responsible for all installation and maintenance costs for the device. The service provider will provide related information, including fees, when a driver registers for the program.
