Fail to remain under the Criminal Code of Canada is properly called Fail to Stop at the Scene of the Accident.

Although the police may lay a charge under the Highway Traffic Act the criminal charge of Fail to Stop has higher penalties, including jail up to five years, and long term licence suspensions.

A charge of Fail to Stop is usually laid by the police where there is a serious intent to escape criminal and civil responsibility, the accident is of a serious nature or accident happened on private property.
